Plea agreement reached in drug case

L’ANSE – A Flint man who had been scheduled to be retried on several drug charges pleaded guilty to cocaine possession in Baraga County Circuit Court.

Harvey Sanders Jr., 54, pleaded to possession of cocaine – less than 25 grams, a four-year felony.

He had been scheduled for a three-day trial to start today. A jury acquitted him of seven felony counts in January.

In May 2013, Michigan State Police troopers pulled Sanders over for driving erratically. He was arrested when troopers found his license had expired. An inventory search of the vehicle found cocaine and about 200 pills.

During the first trial, Sanders testified the material had been brought along by his passenger, Calumet native Justin Jinks, without his knowledge.

Jinks testified the majority of the drugs were his, but Sanders had also planned to sell some in the Calumet area.

Sanders was charged with five 20-year felony counts of possessing less than 50 grams of a controlled substance with intent to deliver – one each for cocaine, morphine, hydromorphone, methadone and oxycodone. He also faced a seven-year felony charge of possession with intent to deliver dihydrocodeine and four-year charges of possession with intent to deliver alprazolam and phenobarbital.

A sentencing date was not available this morning.
